Flash Cookies Trigger Privacy Suits Against Online Marketers

The use of Flash cookies capable of re-installing browser tracking cookies – that users have previously deleted – has triggered the filing of multiple privacy lawsuits against some of the Web’s largest media companies. At issue is a user’s fundamental right to control how their tracking information is harvested and shared.
Issues raised in these lawsuits take behavioral advertising privacy concerns to a whole new level, particularly for sites that participate in ad networks that use Flash cookies. And if your site participates in an ad network that uses Flash cookies, you’d better have full disclosure in your Privacy Policy, or face the consequences.
The Lawsuits
Each of the lawsuits seeks class action status. The defendants include three leaders in the field of behavioral advertising – Clearspring Technologies, Inc., Quantcast Corporation, and Specific Media, Inc.
Behavioral advertising has used traditional “cookies” to track a user’s surfing behavior on the Internet. The cookies track clickstream data including sites visited and the related times on these sites, search engine queries, and content read and downloaded. The data harvested by the cookies is used to create a behavioral profile about a specific user that can be keyed to a specific demographic. Advertisers use this information to target ads that would appeal to the demographic. In essence, behavioral ads are targeted to specific consumers anonymously based on the specific consumer’s past surfing behavior.
The issues raised in these suits significantly increase the stakes in ongoing privacy disputes regarding behavioral advertising. What’s noteworthy in these suits are allegations regarding how a user’s surfing behavior is harvested – specifically, by the use of Flash cookies.
How Flash Cookies Work
First, as background, it’s important to understand traditional cookies. A traditional cookie is a small string of text transmitted by a server to a user that is stored by the user’s web browser. Because cookies are text files, they are not executable. Cookies may or may not have an expiration date, and if there is no expiration date, they exist until the browser terminates. Traditional cookies are often used for purposes of authentication and as identifiers for an online session such as a membership website.
Users generally have the ability to control traditional cookies. Web browser vendors generally offer software tools that offer users the ability to configure their browsers to accept or refuse certain cookies, or to delete them at time intervals of the user’s choosing.
Control over cookies by users presents a problem for advertisers. Cookie deletion by users skews the numbers that track and measure a user’s online activity. The result – targeted, behavioral ads are not targeted to the desired degree of effectiveness, and traffic counts are rendered inaccurate.
Flash cookies address this problem by installing on a user’s computer an Adobe Flash Media Player local shared object (LSO) for tracking purposes. The Adobe Flash Media Player is software that enables users to view content on their computers. The tracking results for the user are later merged with information from other sources for purposes of behavioral advertising. This procedure is similar to the procedure used with traditional cookies.
What’s different with Flash cookies is how they work. An independent report by academic researchers titled “Flash Cookies and Privacy” found that:
* when a user visits a Flash cookie site, it receives a traditional, browser cookie, plus an identical Flash cookie; and
* if the user deletes the browser cookie, the Flash cookie re-spawns the browser cookie.
What’s more, Flash cookies remain on the user’s computer and are hard to detect. By default, Flash cookies have no expiration date, and they’re stored in a different location on a user’s computer than traditional cookies.
Privacy Concerns
Plaintiffs in the current litigation as well as privacy advocates in general object to Flash cookies alleging that:
* Flash cookies are passed to a user’s computer without any notice by, or consent from, the user,
* resulting in a violation of a user’s fundamental right to control how their tracking information is harvested and shared.
Conclusion
The use of Flash cookies in the context of behavioral advertising presents new issues with related privacy concerns.
The Federal Trade Commission (FTC) has not yet issued formal guidelines or taken action against the use of Flash cookies, but that doesn’t mean that Flash cookies are not on the FTC’s radar screen. FTC Chairman Jon Leibowitz recently stated that the FTC is considering implementing a “do not track” list as a response to the growing concern over behavioral advertising in general.
Expect the FTC to act sooner rather than later.
In the meantime, if your site participates in an ad network that uses Flash cookies, you’d better have full disclosure in your Privacy Policy.

2. Have Passion for Your Business.
If you don’t love what you do, you won’t get anywhere with it. Therefore, it is necessary that you find what you are passionate about and work with it. Think of all the people who hate their jobs now, do you think they will climb ranks if they are not dedicated to their jobs? No.
As an entrepreneur, you will have to put in a lot of hours to make your business grow. If you love your business, then you won’t mind putting in 15 hours per day to it. Unlike being an employee where you can relax after a day’s work, expect to think business every hour of the day when you become an entrepreneur. If you enjoy what you are working at…it will not seem so much like work.
7. Network.
Networking is utterly important in the business world more than anywhere else. Especially for small businesses, you’ll need all the help you need. So don’t immediately disregard the woman sitting next to you at a conference or the gentleman you’ve met at a trade fair, because you’ll never know how these people can help you or vice versa. Having a good network is necessary in business because a lot of opportunities will come knocking from your contacts.
8. Keep an Open Mind.
Sure, an MBA from Harvard is ideal, but you won’t need it to succeed in your own business. Think of all the successful entrepreneurs who weren’t able to complete their education. How did they manage to be successful in their chosen businesses? Simple. They kept an open mind and were willing to learn every aspect that can bring good to their business.
Don’t stop asking questions and be open to new knowledge as they come. With the fast changing world of today, you’ll get very far if you keep an open-mind.
9. Have Faith and Perseverance.
Nothing in this world comes easy. This is most especially true for those who want to chase success. Despite all your hard work and dedication, there will always be times when you won’t get the success that you need. For an entrepreneur, this means setbacks, problems, or worse bankruptcy. But successful entrepreneurs don’t treat this as a major thing. In fact, they are the very first ones to get back on their feet and start anew.

New Study Reveals Concerns About Online Shopping & Identity Theft

Technology has made great strides towards making online shopping as safe as possible. But your security can’t be guaranteed. There are many criminals in cyberspace looking for an opportunity to steal your identity.
If you get a queasy feeling in your stomach whenever you type your credit card number on a website – you are certainly not alone. According to research by the Identity Theft Resource Center, the majority of the public is uneasy about online banking and shopping.
The ITRC study conducted in the summer of 2010 monitored trends in what it describes as “consumer concerns about internet transactions.” 500 people who used the internet for banking or shopping within a 30-day time-frame were asked specific questions about their worries.
The findings showed that an alarming 87% of those surveyed have significant concerns about personal information such as credit card information, passwords, user-names and social security numbers being stolen or lost by a business or financial institution in a data breach.
That number isn’t so shocking when you examine another study. This one was conducted by Verizon Business. It recently conducted an investigation into compliance with credit card security standards. In order to protect consumer credit card data, guidelines referred to as the Payment Industry Data Security Standards (PCI-DSS) were developed several years ago. However, Verizon discovered only 22% of companies were compliant with PCI-DSS when they were reviewed for the first time.
It’s no wonder that 81% of those questioned in the ITRC survey are worried about getting phishing emails. 77% are concerned that they’ll see a large increase in spam in their email inbox, and 80% are scared their password could be stolen!
The good news from this study is that many consumers are taking a proactive approach to protecting their identity while shopping online.
Of the consumers questioned in this study, 41% refuse to use a payment method with access to their bank account. Those who switch their online passwords on a regular basis make up 35% of survey participants. Nearly a quarter of participants say they only use low-limit credit cards when shopping online. That means if their personal information is lost in a data breach – the financial losses won’t be too terrible.
Online business should take notice of these numbers and realize that protecting their customers is extremely important. 73% of the people in this survey said they would no longer shop at a website that experienced a data breach. The majority also said they would advise friends and family to avoid that particular website as well.
When you go to an e-commerce website, check to see if they are displaying seals indicating a partnership with trusted web security companies such as Verisign and McAfee.
See if you can find the McAfee Secure Trustmark somewhere on the homepage. It will display the date when the website was last tested. McAfee scans for possible access to personal data, links to dangerous sites, phishing and other online dangers.

Google Challenges Facebook Over User Data

Google has announced it will no longer let other web services automatically import its users’ email contact data for their own purposes.
The search giant dropped the bombshell in a statement released to TechCrunch last Friday, claiming it is their way of protecting its users’ ability to retain control of their personal data on the Internet. They have also amended the Terms of Service for their Contacts API to reflect the change.
In the statement, Google took a swipe at Facebook, challenging what it calls the social network’s *Data Dead End*. It accused Facebook of leveraging Google contact data, without allowing for the reverse flow of Facebook user information.
With more than 500 million users, Facebook uses email services like Google’s Gmail to help new users search for friends already on the social network. Users are given the option to import their Gmail contact list directly into Facebook for the purpose of networking and *friending*.
Google believes the information should flow both ways and is not going to allow third party services access to their data unless reciprocal rights are granted.
Google Place Search Changes How Local Searches are Displayed

Google Local and Map have become a big influence on how people search and get results. We can demonstrate this by searching for ‘accountant’ and the search result returns a broad list of ‘accountants’, but perhaps too broad so we tend to search again by narrowing the result – adding a location to the search – ‘accountant in city’ and the results we see are now closer to home.
So it’s no surprise that Google should be taking a closer look at how we search and attempt to refine the process and provide a more meaningful search result by changing the Google Local search algorithm to make it easier for us to find what or who we are searching for locally.
Today, November 8, 2010 we see searches that reference local business and all the relevant places in that location in a new clustered visual display located in the upper right corner of a search result page. The now familiar map displays each business with red lettered pins, and links to each business. And as you scroll down the page the Google Places Map will scroll with the page so that it is always visible.
In addition to the way we see businesses displayed on Google Places, a new product is being launched – Google Boost.

The main purpose of keyword research is to get you thinking about all the possible keywords you could target, including those used by competitors or more importantly, those NOT used by competitors. So as well as coming up with your own seed list, you should be looking at your competitor’s web sites to see what keywords they are targeting and whether or not you should be using similar keywords.
However, I am a bit concerned by the keywords you’ve chosen for your own site. How many people who type the word *training* into a search engine are specifically seeking training in Microsoft products provided by a consultant in Essex, UK? People typing this search query in might be looking for football training coaches, or training shoes. Or scuba dive training in South Africa. Same goes for the word *Essex*. People typing that in are more likely to be looking for tourist information, accommodation or school project information than for MS training.
You’ll realize this as you learn more about search engine optimization, but you need to choose two, three and four word keyword phrases that are more tailored to your exact offering and therefore more likely to attract visitors to your site who are specifically seeking the services you offer. These visitors have a higher likelihood of converting to customers.
Search phrases you’ve listed like *help with spreadsheets* and *Excel help* are great, but phrases such as *MS Office training* and *how to use MS Word* would be more relevant for you than some of the other keywords you’ve listed.
Once you have a good seed list of keywords, you can run them through a keyword research tool to check how much potential traffic they will bring to your site and streamline your final choices for SEO.

Can-Spam Violation or Creative Marketing?

In a number of industries – generally those that have participated in cross promoting each others product launches and promotions – email open rates are down… way down!
As a result, marketers are trying some – shall we say – “creative” strategies to get their emails opened.
Now, I’m all FOR creativity in marketing, but when you cross the line of ethics and violate Can-Spam laws, you should be blocked. It’s people like that who make it harder for the legitimate marketers to get their subscribers to open up their messages and read them.
It’s marketers like this who make it harder for 3rd party email providers and hosting companies to get legitimate emails through for their customers. More and more, we’re seeing people trying to trick their subscribers by sending messages that appear to be from 3rd party companies.
A recent trend we’ve seen involves a well-known company called GotoWebinar.
Now, before I go into details about what unethical marketers are doing, I need to clarify. It is not GotoWebinar that is engaging in deception. It is people that are using their service. If you’ve ever used GotoWebinar, you probably know that they send a reminder to everybody that registered for your webinar PRIOR to the start time. However, what some marketers have started doing is trying to *trick* their subscribers into thinking “Go to Webinar” has sent out a reminder.
Let me explain…
First things first, there are several “From” fields when you send an email. We’re going to look at the following 3 for the purposes of this article:
. From Name . From Email Address . Reply to Address
From Name
The “From Name” is what appears in the inbox. In other words, “Bob Smith” or “Southwest Airlines”.
When the subscriber scrolls through their email inbox, they can quickly decide if they want to read the message, delete the message, or hold it for later based on this “from” name.
From Email Address
This is actually where the email address is being sent from. This could be bob@bobsdomain.com or promotions@southwest.com.
Reply To Email Address
This is where any replies would be sent if the subscriber hit the reply button in their email.
So what does this have to do with our marketing and why should we care?
Well… according to Can-Spam (and common sense good marketing practices), you CANNOT intentionally mislead your subscribers. And if you use a “From Name” like “Gotowebinar Courtesy Reminder”, you are misleading your subscriber. (Yes, I recently received several emails like this for a product launch that I wasn’t interested in nor was I participating in).
If you engage in these behaviors, and get blocked or banned, or anything else for that matter… you deserve it!
You should be focusing on what you can do to legitimately get people to sign up to attend your webinars. Offer better content. Offer a special prize or bonus. Give a reward for attendance. There are a lot of choices that are better than intentionally trying to mislead your customers.
What’s worse is that in that email I received, they formatted it to “look” like it came from Gotowebinar.
They did this to encourage me to click through and to listen in on the webinar, hoping I’d not realize that I’d never intended to participate.
In fact, when I further looked into the message, I found that it originated on a well-known 3rd party provider. I also found out exactly who was sending the email. (Remember the “from email address”). So… in a nutshell, this tactic obviously didn’t work.
In fact, when enough people complain about this guy (and his affiliates), chances are he’s going to have trouble with the company he’s using to send email and he’s going to cause other people, that are using the same system to send their emails out, to get blocked.
There is good reason that practices like this are against the can-spam laws, and it’s actually helpful for us, legitimate marketers.
It’s time to stop resorting to trickery and learn to market effectively. People like this hurt email deliverability and effectiveness for everybody.
What’s worse is that if you’re using a 3rd party provider to send out mass email messages to your list, you need to be concerned that other people aren’t following these practices.
There are only two real safeguards against this:
1. Follow Can Spam Laws in your own marketing; and
2. Host your own email on your own server.
Otherwise, you never know what shady marketers are doing that can affect your deliverability overall.

In short, if you become an authority in your field, people will follow you, listen to your every word and even buy products from you.
Keep in mind that your business tactics should always be ethical. You should be persuading a person to buy a product because they really need it, and you are certain that this product will bring value into their lives. Ethical business practice is the ability to truly give somebody the power of choice, and not forcefully loading a product onto them, which they know in the back of their minds they will never have any use for.
Once you have your list of happy followers, you need to be very careful not to abuse that trust. Only promote products that you yourself would use. If you promote junk, you will quickly lose credibility in the eyes of your followers, and they could in turn end up following somebody else.
